JOINT ACCOUNT HOLDERS DON’T ALWAYS AVOID PROBATE

The mere fact that someone held an account jointly with a decedent doesn't necessarily mean he will avoid probate. While there is a statutory presumption that a right of survivorship is created when a party to a joint account dies, this presumption can be overcome with evidence showing that undue influence was used in the creation of the account, or that the account was solely for the convenience of the depositor. This was highlighted in a recent NJ appellate court…

Long-Term Care and You

November was a Long-Term Care awareness month.  At the November 20th meeting we had a discussion about the cost of care for our loved ones as well as the affects on the caregivers.  How would you handle a situation if you or your loved one will need help with basic daily activities such as bathing, dressing, eating, etc?  Are you prepared emotionally and financially?   Do you know what your options are?

For more information, feel free to contact me.

Lessons Learned from a Brain Tumor

by Karen Perry-Weinstat, July 2013

In April 2012 I was as my desk working after having gone for an MRI due to chronic headaches I was experiencing.  It was the neurologist.  When he told me the test revealed that I had a large brain tumor, I laughed.  My first thought was, how ridiculous!  I don’t have time for this!  I’d recently been through two other major ordeals.  This was just too much!

I laughed all the way to his office the…

HIT BY THE NJ EXIT TAX FOR SELLING REAL ESTATE? RECOVER YOUR MONEY QUICKLY

If you’re a non-resident selling investment real estate in New Jersey, there’s a unique NJ tax you should be aware of. Both residents and non-residents always had to pay income tax on the gain upon the sale of real estate. This tax is required to be withheld for non-residents.  The “Exit Tax”, which came into law six years ago, requires the seller to file a GIT/REP form (Gross Income Tax form) in order to record a Deed for the transfer of his property. When a non-resident sells the…

The POWER of Thank You!

Saying thank you in today’s high powered high-tech marketplace has been relegated to the status of an unwanted stepchild in our marketing mix. We spend so much time researching, planning, targeting our next move that we fail to realize the impact that a simple thank you can have on our existing customer base or on someone we have just met.  We build these vast and complex business models failing to realize that they must be lubricated regularly. A Thank You is the oil that makes the…

IRS Scrutinizing Small Businesses

Even if your business doesn’t have “Tea Party” in its name, you may be receiving a notice of inquiry from the IRS. The controversial notices, titled ‘Notification of Possible Income Reporting’, have already been sent to at least 20,000 small businesses across America. The IRS is gathering data from several third parties, including credit card companies, to check that all income is being reported. Form 1099 has been modified in a manner that provides the IRS with more details about credit and…

The Changing Corporate Immigration Landscape

David began: "Clearly the most interesting trend in U.S. Business Immigration Law is President Obama's commitment to Comprehensive Immigration Reform ("CIR").

"The recent initiatives under the Deferred Action and Childhood Arrivals (DACA) Program in August 2012 seemed to be the precursor of a DREAM Act. Prospects of CIR could present immigration law options for the over 11 million undocumented foreign nationals in the U.S. The Nachman Phulwani Zimovcak [NPZ] Law Group, P.C. continues…
